Where the amount is most often cut
- labour rates lower than in workshops in your area,
- cheaper replacement parts instead of original ones – although under OC you are generally entitled to the cost of original parts,
- wear deductions on parts – under OC allowed only if the insurer proves the repair increased the car's value,
- missing items: single-use parts, paint materials, additional work,
- discounts on parts and materials that you don't have to accept.
How the appeal works
- We analyse the estimate and the claim documents.
- We compare the valuation with real labour rates and parts prices.
- We file a reasoned appeal (complaint) with the insurer.
- The insurer generally has 30 days to respond, and up to 60 days in particularly complex cases.
- If it refuses, we discuss next steps with you – e.g. a request to the Financial Ombudsman (Rzecznik Finansowy).
Already received the money?
Accepting the payment doesn't close the matter – you can still claim an additional payment later. Claims under the at-fault driver's OC generally become time-barred 3 years from the day you learned about the damage and who is liable for it – but no later than 10 years from the incident, or 20 years if the damage results from a crime.
